I had gone to see this dentist because I had a tooth that was sensitive to cold on my right upper jaw in Nov2002.She didn't find anything wrong with it.She instead found that something was wrong with left 2nd upper premolar on the X-ray.I told her I had a root canal on that tooth from India done in Feb2002.She said that it was a not root canal and she couldn't make out what it was on the X-ray.She scraped it off,found the root canal and uneasily told me there was a RC.Didn't say sorry at all, filled up the tooth and sent me home.Now this got infected and the infection spread to the next tooth which now required a RC, post and crown and we paid $ 800 for it. 2yrs later the tooth she had scraped the filling off broke.At the time my ex and I were separated and I couldn't pay her. My ex had promised to pay her, but went back on his word.I'm an immigrant from India trying hard to make it here and can't pay her.She refuses to consider her mistake and make concession for her negligence.?to do

Reply:See a lawyer and tell her the story. At best, she'll charge you $25 to write a letter saying that if she continues to pursue this, you will take her to court for negligence (or something) and sue big time. That may be all you have to do. If not, take her to court. And I'd file a complaint with the Better Business Bureau in your area and with the medical board that watches over her.
Reply:The Better Business Bureau has mediators. I would definitely check with them. Dentists and doctors are notroious for getting by with most of the harm they do to their patients. It is time they were held accountable.
Also, first you may want to write a letter of complaint to the dentist and a copy to the American Dental Association and a copy to the Better Business Bureau.
Reply:I don't know if you could do much in terms of malpractice, since you didn't report anything right away. It doesn't hurt to see a lawyer. You can always work out a payment plan with the dentist. And just pay monthly what you can afford until you are done with the bill
Reply:Try telling her you will be seeing a lawyer about this little problem and that you will also be submitting an editorial to your local paper spelling out exactly what happened and how she is harrassing you now. Some people don't respond to threats of legal intervention but threaten to publicize her carelessness and that messes with her livlihood. If she doesn't back down then go ahead and write your editorial.

Reply:You need to see a personal injury lawyer right away, file a complaint with the Dentist Association, and I bet the Dentist's insurance company will give you a nice settlement just to keep it out of court. A lawyer will take this on contingency basis. Don't delay! Secure your rights before the statute of limitations run out!
